The FBI and Department of Homeland Security under former President Barack Obama found evidence that Rep. Ilhan Omar (D-MN) committed marriage fraud with a man suspected of being her brother, The New York Times reported on Thursday.

Current and former officials told the Times that prosecutors declined to pursue a felony marriage fraud case against Omar because the five-year statute of limitations had expired. Omar, whose real name is “Ilhan Nur Said Elmi,” according to the Department of Justice, married Ahmed Nur Said Elmi in 2009, and the couple legally divorced in December 2017. She has repeatedly denied that Elmi is her brother.

The allegations raise two potential criminal issues for the Democrat congresswoman as federal law prohibits knowingly entering a marriage only to obtain a green card, and all 50 states prohibit siblings from marrying.

Omar’s former husband and suspected brother, obtained a provisional two-year green card after he married Omar in 2009. He attempted to make his status permanent but abandoned the process after immigration officials requested additional information regarding his marriage to Omar. Elmi then left the United States and moved to the United Kingdom.

Obama called the Trump administration’s probe into the Minnesota congresswoman “appalling,” despite his FBI reportedly finding evidence that Omar committed marriage fraud.

“It is a basic principle of American democracy that the government can’t selectively target individuals simply because of their political beliefs or what they say, but that’s exactly what the Trump Administration is doing to Congresswoman Ilhan Omar of Minnesota,” Obama said after federal authorities executed a criminal search warrant at Omar’s Washington, D.C., home. The raid on her home is part of the ongoing criminal investigation into Omar under the Trump administration.

Authorities left the congresswoman’s home with several of her personal belongings including her phone and notebook. Authorities also reportedly collected DNA evidence.

Obama argued the federal government was investigating Omar only because she is “one of the Trump administration’s fiercest critics.”

In his 426-word statement, Obama did not mention the FBI’s reported investigation under his administration or the evidence officials say it uncovered.

The Trump administration is also reportedly looking into potential false statements on the congresswoman’s immigration documents.

Omar says she was born 1982. If so, she would have been eligible for naturalization through her father’s green card status since she would have been under the age of 18 when she arrived in the United States. However, her birth year according to her Minnesota House of Representatives profile is 1981.

If true, that would mean she was too old to receive citizenship through her father. Omar’s own memoir also points to her being born in 1981 states that she was “eight years old when civil war broke out in Somalia” in 1989.
