Sen. Josh Hawley (R-MO) warned Wednesday that the legislation contains a \u201cbig, big problem,\u201d arguing its federal preemption language could override Missouri\u2019s law targeting transgender-identifying athletes.\u00a0 <\/span><\/p>\n

\u201cI\u2019m against men in women\u2019s sports, and Missouri has a law that bans men in women\u2019s sports that applies to collegiate eligibility,\u201d Hawley said. \u201cMy concern is that this bill as it\u2019s currently drafted would overturn Missouri law. Twenty-seven states have similar bans. This is something that needs to be fixed.\u201d\u00a0<\/span><\/p>\n

Hawley has filed an amendment with Sens. Jim Banks (R-IN) and Tommy Tuberville (R-AL) that would explicitly exempt state and local laws prohibiting biological males from competing in women\u2019s sports from the bill\u2019s federal preemption provision.<\/span><\/p>\n

Tuberville called the protection of women\u2019s athletics \u201cthe civil rights issue of our time.\u201d <\/span><\/p>\n

Banks added, \u201cAs the father of three daughters, I can\u2019t support any legislation that would preempt Indiana\u2019s law. This amendment would make sure the Protect College Sports Act protects female athletes.\u201d\u00a0<\/span><\/p>\n

\u201cThat\u2019s simply inaccurate,\u201d Cruz <\/span>said<\/span>. \u201cThe legislation explicitly has language, number one, that nothing in the bill alters Title IX in any way. And, number two, it explicitly says on eligibility that you can be blocked from eligibility for violating a state law. That was written very deliberately to avoid disturbing the twenty-seven states that have acted to protect women\u2019s sports.\u201d\u00a0<\/span><\/p>\n

Despite Hawley\u2019s questions, Senate Majority Leader John Thune (R-SD) filed a cloture motion to advance the bill to a vote on Friday. <\/span><\/p>\n

\u201cI\u2019m hoping it can be worked out,\u201d Thune said. \u201c<\/span>I know what it\u2019s about and I think \u2026 some of our members have pretty good answers to some of the questions he\u2019s raising,\u201d <\/span><\/p>\n
